Essay on Should Justice be the Supreme Virtue of Societies
Should Justice be the Supreme Virtue of Societies? Social justice is distributive. It operates under the principle that each person must get his or her due. However, it is quite contentious as to precisely what each persons due is and thus opens the debate as to what justice is. Moreover, once a definition of justice is agreed upon (in a particular state), the question may be raised of how important it is. Is justice salient, or is there another concept that transcends its authority? Some argue that an aggregative concept would best suit a first principle (if indeed there were one). I would argue that justice is indeed salient, that without it there would be no such thing as civil society andâ⬠¦show more contentâ⬠¦The conclusion that may be drawn from this is rather more subtle. It is that justice is derived from a starting point of equality. Social Contract theorists such as Rousseau and Locke, suggest that this equal starting point is an imaginary one whereby individuals come together and give all that they possess, both physically and non-physically to the State. They do this because they realise that if everybody gives equally (i.e. everything) then nobody loses anything, as the state (which is constituted by the individuals) possesses all things. From here on it is possible to provide protection by the state, and those objects that were once possessions now become property. More recently, John Rawls has taken a slightly different approach to this classic Contract Theory. Rawls argues that if we take people in an original position we would find that rational people would choose a set of principles that would call justice fairness. This original position that he refers to is a hypothetical situation in which rational people were held behind a veil of ignorance in that their destined social status and wealth would not be known. He argues that the persons in the original position would choose two rather different principles: the first requires equality in the assignment of basic rights and duties,Show MoreRelatedPlato And Aristotle On Justice And Law1565 Words à |à 7 Pageslaws should be supreme over each citizen including the ruler(s). Reflection on Change Management Process
Question: Discuss about the case study for Reflection on Change Management Process. Answer: Introduction: Change management process is very complicated and it needs commitment from all the stakeholders of the organization from top to bottom of the organizational vertical. The process from inception to the execution and subsequent continuous improvement needs a strategic approach and the current discussion is about this approach and the possible typical considerations to be considered in devising a change management process. Also discussion is made in reference to IT company change management process. The process and factors of significance: Factors to be considered for critical evaluation during the change management implementation process: Change management is a critical task, and the outcome of that will depend on the collective action of different stakeholders of the organization and their commitment towards the change. Hence during the implementation, the sentiments of the stakeholders involved in the change process need to be considered. Firstly, a right motivation is to be provided to all the stakeholders involved in the process, their sentiments and the concerns towards the change to be considered. Incase, if there are any differences they need to be mitigated at the outset. Once these basic tasks performed, the actual change implementation process needed to be initiated. Other important aspects to be considered are the strategic plan and the phases in which the change management need to be performed. A well designed operational plan is to be kept ready before the actual implementation of the change management process. Feasibility of the change, stakeholders empathy towards the change, possible outcomes of the ch ange are some of the several factors to be considered for critical evaluation before the actual change implementation process. Other factors of importance are the time span of the implementation process, resources required for change actual strategic plan of a change process. All of them need to be critically evaluated during the change management implementation process (UOW, 1988). Inferences to an IT company: In a real IT company scenario typical approval by the top managerial committees, employees consideration and analysis of the outcomes, etc. need to be considered in the change implementation process. Critical success factors: There are several factors to be considered for the complete success and effectiveness of a change process at any organization(Hall,2006). Any way the typical success factors needed for a change management in an IT organization are as follows 1. Visibility: There should be complete transparency in the way the change management is proceeding, there should be a clear and visible plan for the change management and all stakeholders should able to perceive what actually is going in the organization in this setup. 2. Accountability: There should be responsibility towards the changes planned and being incorporated in the system, the stakeholders should able to know what is going on and they are responsible for the changes and the outcomes of the changes. 3. Measurability: A well-established system of metrics of the consequences of the changes in the organization is very much important and the system should be followed in complete agreement with the change expectations. 4. Continous improvement: Identification of the gaps in the systems and the rectification of the gaps from time to time are very much essential for keeping the system on track and to achieve the ultimate envisioned success (Margulies, 1973). Typical inferences can be acceptance by the employees, co-operation for change implementation, readiness for taking in the accountability for the change management process etc. Other factors can be implementation of the changed system performance in terms of reduction in the operational delays, increased customer satisfaction index towards new change process, sustenance of the change in terms of employees and customer feedback and of course the system performance as per the expectations. Resistance to change Description of factors of change: Visibility of the change management/Transparency may be resisted or may be hindered, by means of poor communication and poor collaboration of the stakeholders involved in the change process. Confusion and ambiguity and subsequent apathy towards the change initiatives are the likely symptoms of the resistance (Dent,1999). Accountability lacking can materialize due to the poor commitment on part of top management. Lack of commitment and the lack of planning or poor planning can be symptoms of resistance to accountability Metrics can be implemented only with the acceptance of the system under control, employees and the system should be evaluated for the change in the psychology or temperament or any particular change behavior with only the particular stakeholder agreement. Resistance towards the metrics or poor outcomes of the metrics can be result of the resistance in this domain. Continuous improvement is possible only with a well-established system of proactive change. Every aspect of the system should support the change and should contribute for positive change. Pro-activity and positivity are the need of the hour and failure of feedback and control is the symptom that can be directly attributed to the resistance of the contributors (Lewis, 2010). Graphical model of change management frame work: Figure 1 Graphical representation - Change management: Phase-1: Defining the objectives Visibility/Transparency Phase-2: Strategy operational plan - Accountability Phase-3: Implementation Metrics Phase-4: Sustenance Continuous improvement Conclusion: Change management process is very critical for the success of an organizational change implementation. Apart from commitment a systematic strategic operational plan is required. With due consideration to all the possible resistances and other organizational problems that may surface during the process, organizational change can be implemented. Lincoln Douglas Debates
Lincoln Douglas Debates Lincoln Douglas debates are those debates between Stephen Douglas, who held the position of a Senator as a Democratic Party candidate, and Abraham Lincoln, who was the Republican candidate for Senate in Illinois. These two leaders were contesting for election into the U.S. Senate in 1858. Lincoln was opposing Douglas who wanted to be reelected. The two leaders were competing for control over Illinois legislature. The main topic that was argued in these debates was slavery.Advertising We will write a custom essay sample on Lincoln Douglas Debates specifically for you for only $16.05 $11/page Learn More Douglas was not popular on one hand while on the other hand Lincoln was popular since he had held campaigns earlier. They held seven main debates in their campaigns. One of the debates was held at Washington Square, Ottawa. They also held another debate in Freeport where more than 15,000 people attended (Lincoln-Douglas Debates 2). Other debates were held at Co les County Fairgrounds, Union County Fairgrounds, Broadway and Market Street, Old Main, and Washington Park. Abraham Lincoln and Stephen Douglas believed in opposing ideas. According to Lincoln, freedom and slavery can never be compatible (Murrin et al 549). In other words, Lincoln believed that there is no way we could have freedom and at the same time we have slavery. Each can only prevail at a time. This was the main theme for debates between Douglas and Lincoln in 1858. In his campaigns, Lincoln used a common slogan that ââ¬Å"A house divided against itself cannot stand.â⬠(Murrin et al 549). He was implying that the sitting government could not prevail any longer. In other words, Lincoln argued that since the prevailing government system was half freedom and half slavery, it could not last permanently. It was about to collapse. These two opposing systems are unsustainable within the same government. There was a fraction of the people who were advocating for legalization o f slavery in all the states. On the other hand, the republicans were against slavery since they thought it was not feasible with freedom. They wanted to combat slavery completely. Lincoln commented that their aim was to avoid the growth of slavery as well as placing it in a situation where the public would be free and confident that it would never haunt them once more (Murrin et al 549). In reaction to this, Douglas questioned Lincolnââ¬â¢s argument that slavery cannot coexist with freedom. Douglas commented that he didnââ¬â¢t know the reason which could prevent a country from surviving with both freedom and slavery since the same had already survived for 70years (Murrin et al 549). Douglas explained that Lincolnââ¬â¢s argument was not realistic since it would trigger the Southern people to withdraw from the stable union. He commented that although he was not advocating for slavery, the people from the Southern states opted for it and thus it was their right to have it (Mur rin et al 549).Advertising Looking for essay on history? Lincoln asked Douglas whether there could be any way through which slavery couldnââ¬â¢t exist without violating the then constitution (Nicolay 90). Douglas responded that this could happen. People have a legal right to include or exclude slavery. According to Douglas, slavery could not exist unless supported by the police. In their debates, Douglas argued that freeing of slaves in Illinois imply equality of all the people despite their race. By abolishing slavery, the Negroes would enjoy the rights and privileges of the citizenship. On raising this statement, the crowd showed a lot of opposition to the situation where Negroes would enjoy equal rights with the natives. In response to Douglasââ¬â¢s claims, Lincoln commented that he was neithe r advocating for political nor the social equality of races. He argued that ââ¬Å"ultimate extinctionâ⬠cannot take place abruptly; slaves have to emigrate from the countryâ⬠(Murrin et al 549). In their debates, Lincoln and Douglas were differing in their views concerning the blacks who were mostly slaves. Lincoln advocated for the blacks while Douglas was against them. Lincoln argued that the blacks must be allowed to enjoy the natural rights which had been proposed through the declaration of independence. Every person had the right to liberty and slavery was a violation of the blackââ¬â¢s liberty. Lincoln thought that there was no way this declaration could be adhered to with prevalence of slavery. Lincoln criticized Douglas for showing less concern on the issue of slavery. In fact, Douglas claimed that he was not looking forward to seeing slavery come to an end. He insisted that this arrangement had to survive for the sake of the southern states. The prevailing sol idarity among the states would be interfered with in case slavery institution was abolished. In conclusion, this discussion has clearly analyzed Lincoln Douglas debates of 1858. The central theme of their debates as already seen was slavery. The two candidates used this as a slogan in their campaigns. Lincoln thought that the prevailing government where Douglas was the leader could not last since it integrated slavery and freedom. On the other hand, Douglas proposed that such a government could continue to survive since it had survived in the previous 70 years. Dissatisfaction in the tasks has led to people leaving the company at an alarming rate. For instance, Saunders contents that he is staring at three resignations from his top sales people because of dissatisfaction. The sensitive point is the relationship between the subsidiaries and the way they are respectively managed. The structure is not compact and flexible enough to realize a need for change amid growing levels of dissatisfaction and employees. The structure does not seem to give rise to sufficient manpower to manage the available work processes. Decision making processes are not fruitful in the long run. Saunders seems to blame Jim for proposing the merging of the subsidiaries. This is a structural decision that left the sales people asking to resign. The structure (attached in the appendix) is not as compact as expected. For example, the president seems to be in charge of all operations while the second-in-command groups have little to do with the decisions of the company apart from financial. Personal statement for PHD admission - Essay Example Likewise, my Bachelorââ¬â¢s degree represented a total GPA of 3.13; with a major in Computer Engineering. Pior diplomas and associateââ¬â¢s degrees were earned in Computer Networking Techniques and Mechanical Technology; with respective GPAs in excess of 3.7. As can be noted from this cursory examination of prior scholarship, my interests in this field have not come to me recently; instead, they have been the result of a lifelong interest in science and technology; as well as an overarching interest in how efficiency can be achieved and greater usefulness represented to broader humanity from existing and newly developed technologies. As I am currently within my very last semester of my Masterââ¬â¢s program, I am only taking one course at the current time; ECE602. As such, with all of my available free time devoted towards achieving the highest grades possible within this particular course, I am confident that my GPA will increase from the point that has been listed currently. A further rational for seeking to apply for this Ph.D. program is contingent upon the fact that I have a great deal of familiarity working with Professor Chien; an individual who has proved instrumental in guiding me throughout my graduate work thus far. Upon asking him as to whether or not he would work with me as a potential graduate student, Professor Chien readily agreed. This is partially due to the fact that I have had a long working relationship with him over the course of ECE471, ECE487, and ECE488; all of which I served as a TA for him. Furthermore, my working relationship with Professor Chien extends beyond merely working as a TA; as last summer Professor Chien inquired as to my availability for TASI (Transportation Active Safety Institute). While working on this project, I worked closely with both Professor Chien and stakeholders within Toyota as we worked to develop a car safety project that utilized distance sensors as a means of effecting safety

In Pride and Prejudice, Jane Austenââ¬â¢s usage of letters allows the reader to fully comprehend the situation and certain feelings of the characters. The Usage of Janeââ¬â¢s Letters in Pride and Prejudice In Pride and Prejudice, Jane Austenââ¬â¢s usage of letters allows the reader to fully comprehend the situation and certain feelings of the characters. For example, the two letters sent by Jane Bennet to Elizabeth Bennet in Chapter 46 allow the novel to arrive at a turning point in many different aspects. The obvious purpose of the written letters is to inform the reader of the events at hand regarding Lydia Bennet and Mr. Wickham. However, these letters allow changes to take place in other relationships as well. Jane Bennet illustrates herself much in the letters that she composes. She is constantly optimistic and trusts people immensely, shown in the lines ââ¬Å"But I am willing to hope the best, and that his character has been misunderstood.â⬠Jane is constantly considering the feelings of other people and she conveys that she does not like to impose on others. She states in the second letter, ââ¬Å"Now as the first shock is over, shall I own that I long for your return? I am not so selfish, however, as to press for it, if inconvenient.â⬠Even in her opening statement in the first distressed letter Jane states, ââ¬Å"I am afraid of alarming you-be assured that we are all well.â⬠These statements easily show her compassion and consideration for others. When describing the state of the rest of the family because of Lydiaââ¬â¢s actions, Jane precedes each of their names with the word ââ¬Å"poor.â⬠For example, she writes ââ¬Å"my poor mother is really ill and keeps to her room,â⬠and ââ¬Å"Poor Kitty has anger for having concealed their attachmen... ...y because of the incorrect address is vital in conveying Janeââ¬â¢s emotions to the reader. It is apparent that Jane Austen intended these two solitary letters to play a vital role in the novel. These letters single-handedly brought on the climax of the novel and allowed many different relationships to develop. If the letters were not available to the reader or even simply mentioned, the novel would be lacking in a connection with the reader. These letters convey emotions and worries that otherwise might not be discussed in person, such as the negative comments about Mr. Wickham and his supposed intentions for Lydia Bennet. The letters also allow the reader to personally imitate the internal reactions of the original receiver in the novel. Jane Bennetââ¬â¢s two letters to Elizabeth certainly fulfill these literary functions and are quite essential to the novel.

Is Morality a Talent? Essay
One typically wouldnââ¬â¢t think of morality when it comes to the nature versus nurture debate about the origin of personality, but after being faced with this issue I have realized that the origin of morality can be debated about all the same. With the classic nature versus nurture debate I myself have come to a conclusion that we are composed of a little bit of both nature and nurture, and I am still finding myself coming to that same conclusion with morality. I believe that morality is not only a talent, but is a learned skill as well. Just like personality, certain environments or events can lead to a manifestation of certain traits within us. I think that morality can exist at different levels amongst different people based on their genetic traits as well as their environmental or cultural experiences. Based on what I learned after reading Sam Harrisââ¬â¢ ââ¬Å"The Moral Landscape,â⬠I have gathered an understanding of moral truth, and how that can apply to morality as being a talent and learned. His disagreement with moral relativism, analysis of psychopaths and the theories behind the nature versus nurture debate have lead me to my conclusions. Moral truth is the belief that there is a universal code of ethics that has lead us through the ages and has impacted our societyââ¬â¢s understanding of morals today. I agree with Harris on the subject of moral truth. I think moral truth supports both the nature side and the nurture side because it exposes the universal aspect of morals, which is learned, and shows the natural desire in humans to want to exceed primitive standards through morals in order to promote survival. Many ethical codes truly are universal, such as ââ¬Å"donââ¬â¢t kill. â⬠If we donââ¬â¢t run around killing each other in our day to day lives, we will survive and thrive. That is an example of a known moral truth. By comparing first world civilizations to Western civilizations you will find that yes, we have all survived, but it is quite clear that one civilization is thriving more than the other; Westernized civilizations. They are less primitive, more technologically advanced, have better medicine and are as a whole wealthier. Why are these third world cultures not advancing? Out of many reasons, I think that one could possibly be that their ethical codes are far less developed than those of modern Western culture. This observation has led me to believe that there are cultures that are superior to others. Although moral relativism is a widely accepted theory, it is clearly incorrect. Moral relativism would seem like a pleasant theory to believe wouldnââ¬â¢t it? It removes intolerance of other cultures, religions etc. and allows us to ââ¬Å"justifyâ⬠or ââ¬Å"understandâ⬠certain events based on specific, or relative, codes of ethics. While certain events or behaviors may not be right to one culture, they may be considered normal in another and everyone can go about their lives as if nothing wrong had happened. These assumptions are terrible flaws in the thinking of our society and of the world. Harris uses an example of moral relativism that he encountered in a conversation with a woman after an academic conference. He provided her the scenario of a culture that would pluck the eyes out of every third born child based on their religious beliefs. The woman stuck to her moral relativism, and said that this culture was not wrong since they were doing this for religious reasons (Harris, 33-34). How can this possibly make any sense? Morality and ethics lose all meaning if they are merely ââ¬Å"relativeâ⬠to every culture where horrendous rituals are practiced. If things like ritual murders were allowed in our society, we would not survive, we would not thrive and we would degenerate the human race intellectually, morally and psychologically. This brings meaning back to morality and ethics. There are universal codes that exist in order to promote our survival and happiness, or well being. Based on this understanding of moral truth, I believe that morality is both learned and genetic because moral truth and its implications show the experiences in which we have learned moral codes, and the promotion of survival that is instilled within the human race. If morality was solely genetic, or a talent, then the research on psychopathic brains would be highly disturbing. In an NPR articled called A Neuroscientist Discovers a Dark Secret by Barbara Bradley Hagerty I learned about the actual discoveries that neurology has made about the psychopathic brain. In an abnormal brain found in serial killers by research conducted by James Fallon, a neuroscientist of the University of California-Irvine, the orbital cortex exhibits a major lack of functioning or is completely non-functioning. While describing the abnormality of the orbital cortex Hagerty said that it is ââ¬Å"the area that Fallon and other scientists believe is involved with ethical behavior, moral decision-making and impulse control. â⬠The orbital cortex also controls the amygdala which controls aggression and appetite (Hagerty). Fallon ended up discovering that he also had the same error in his brain. He even specified a gene that he had found in all but one of his family members, descendents of multiple murderers. However, none of these people had become serial killers, but could they? ââ¬Å"He doesnââ¬â¢t believe his fate or anyone elseââ¬â¢s is entirely determined by genes. They merely tip you in one direction or another. â⬠(Hagerty). This research goes to show that genes are not entirely responsible for your predispositions to act violently or otherwise abnormally. These results are showing that it is possible that the orbital cortex controls our ethic and moral actions, but abnormality or damage to this process does not ultimately control our actual thoughts and actions. These conclusions provide actual evidence to support my claim that morality is both talent and learned. If our moral impulses are regulated by the orbital cortex, but our actions are not determined, this is leading me to believe that our genes are not fully responsible for our personality, morality, beliefs, talents, etc. but they do have the ability to gear someone towards one side or the other. Morality is partially genetic, however our environments have the ultimate responsibility. If we have an experience that manifests within our psyche, it can ultimately ignite something within us that turns on or turns off certain physiological processes in the brain. Therefore, the classic nature versus nurture debate can and will never be resolved. Simply because there is no resolution. Neither nature or nurture can be held fully responsible for our actions or who we become throughout the effects of our daily experiences in life. Harris, however, disagrees with me. He believes that morality is purely a talent. He mentions this evidence from the neuroscientist James Blair who ââ¬Å"suggests that psychopathy results from a failure of emotional learning due to genetic impairments of the amygdala and orbitofrontal cortex, regions vital to the processing of emotion. â⬠(Harris, 99). Sounds familiar, doesnââ¬â¢t it? However, he doesnââ¬â¢t mention that there are plenty of people with the same genetic predispositions as psychopaths, who arenââ¬â¢t considered psychopaths and arenââ¬â¢t even aware that they have these genes. Heââ¬â¢s giving nature full responsibility in this case, and states that people can exhibit moral talent. (Harris, 99). Although this is possible, that people can have moral talent, it is not the sole cause for our morality. Our society is governed by morals. Social norms and constructs have developed and evolved throughout history that have lead to the health and growth of our society. These rules we live by are instilled in our culture, and regulated through our judicial system. But they did not just appear there over night. There were millions of events included in diverse human experiences that lead us to live by our guidelines, which are continually evolving as time progresses. Generally, some people are more predisposed to be more caring in their demeanor as well as more cautious and aware of the moral outcomes of their actions. And then, there are those who are the opposite. However, for the most part those who are morally ââ¬Å"challengedâ⬠genetically do not act out in immoral ways. Harris points out the biological aspect of this, ââ¬Å"While it may be difficult to accept, the research strongly suggests that some people cannot learn to care about others. â⬠(Harris, 99). Well sure there are people like this. Of course there are! We arenââ¬â¢t all going to be cookie cut copies of one another. We are all unique. But if we are apparently so scared to accept this, I would like to know why? Just because some people donââ¬â¢t have the compassion for other people doesnââ¬â¢t mean that they have a compassion for negatively impacting other people. Does a lack of concern fully constitute immorality? In some cases, yes it does. For instance if someone had a thought that would lead to actions that injured other people and they chose to partake in this action anyways, then that would be immoral. But if someone is just traveling through life alone and lacking of a concern for others deep down but just keeping to themselves, this does not constitute immorality at all. We are afraid of something that is inevitable: diversity. Not to suggest that this diversity requires relativism, but to suggest that diversity is part of humanity and there will be negative or harmful people in the world. No matter what we discover about the neurology or origin behind morality, immorality will always exist and persist throughout humanity. With this being said, I agree with Harrisââ¬â¢ statement that there are people who are less morally ââ¬Å"talentedâ⬠than others. Research suggests this, but it also suggests that environmental experiences also have their hand in our morality. I also think that if morality was solely genetic, there would be grounds for moral relativism. If our brains made us do it, who can say that one thing is wrong or right? It does not match up. The effects on society would be detrimental, our moral responsibility would be diminished. Harrisââ¬â¢ evaluation of the possibility of a moral talent continues to lead me to believe that morality is both a talent and learned. In conclusion, there are many different theories to explain why we are the way we are. We may be who we are strictly because of physiological brain processes and genetic hardwiring. We may be who we are strictly because of our environments and experiences. But how can we decide which it is when there is so much evidence pointing to both nature and nurture? Well, like I said, we canââ¬â¢t. What we can realize is that both nature and nurture have major effects on our morality and ethics. Through the arguments of moral truth, we can see that there are learned moral concepts that we have acquired and have incorporated them into our societies. However, there is also the drive for survival within us that provides us with instincts to distinguish right from wrong. Through the research of criminal brains, we can isolate parts of the brain, their processes, and even genes to confirm that morality may be fully genetic. However, we can also see that the brainââ¬â¢s functioning doesnââ¬â¢t completely determine our personalities, moralities or actions. Instead, our environments or experiences that we have learned from can shape who we are for the better. Harrisââ¬â¢ evaluation of moral talents can show us that there is diversity amongst us, moral diversity. But we are not doomed to be what our brain may want us to be. In fact, we may not even be conscious of what our brain ââ¬Å"wantsâ⬠us to be. We incorporate our experiences into our being, which can make or break our genetic dispositions. Based on my conclusions that Iââ¬â¢ve come too after reading ââ¬Å"The Moral Landscape,â⬠I believe that morality is not only caused by nature, but that it is both a talent and a learned skill that we acquire through our lives. Human resources hold significant meaning to an organization the mother board of the device, the engine to a vehicle, without it things wonà ¢Ã¢â ¬Ã¢â ¢t run. r. The HR professionals must be able to demonstrate their understanding of how the organization can generate revenue, who their target customers are and vendors who will give the best deals to save money, what their business cycles are, and what helps to distinguish their products and services from their competitors. They have many duties such as Duties and Responsibilities: à ¢Ã¢â ¬Ã ¢ working closely with departments, increasingly in a consultancy role, assisting line managers to understand and implement policies and procedures; à ¢Ã¢ ⠬à ¢ promoting equality and diversity as part of the culture of the organization; à ¢Ã¢â ¬Ã ¢ liaising with a wide range of organizations involved in areas such as race relations, disability, gender, age, religion and health and safety; à ¢Ã¢â ¬Ã ¢ recruiting staff: this includes developing job descriptions, preparing advertisements, checking application forms, short listing, interviewing and selecting candidates; à ¢Ã¢â ¬Ã ¢ developing policies on issues such as working conditions, performance management, equal opportunities, disciplinary procedures and absence management; à ¢Ã¢â ¬Ã ¢ advising on pay and other remuneration issues, including promotion and benefits; à ¢Ã¢â ¬Ã ¢ undertaking regular salary reviews; à ¢Ã¢â ¬Ã ¢ negotiating with staff and their representatives on issues relating to pay and conditions; à ¢Ã¢â ¬Ã ¢ administering payroll and maintaining records relating to staff; à ¢Ã¢â ¬Ã ¢ interpreting and advising on employment legisl ation; à ¢Ã¢â ¬Ã ¢ listening to grievances and implementing disciplinary procedures; à ¢Ã¢â ¬Ã ¢ developing, with line managers, HR planning strategies, which consider immediate and long-term staff requirements in terms of numbers and skill levels; à ¢Ã¢â ¬Ã ¢ planning and sometimes delivering training, including inductions for new staff; à ¢Ã¢â ¬Ã ¢ analyzing training needs in conjunction with departmental managers. This may seem like a lot to handlebut with education and the right training things arenà ¢Ã¢â ¬Ã¢â ¢t so difficult. Technology is the first key as to the change in human resources, computers and the internet makes for convenience in the workplace. Before the internet became huge companies had to hang a sign in the window for hire in hopes that someone would come in to apply. So HR had to scramble thorough piles of paper application looking for talent and who had what it takes to best fit the company. Of course this was very time consuming but they made it work. Today paper applications are almost extinct everything is done on smart device rather ità ¢Ã¢â ¬Ã¢â ¢s a computer, laptop, smart phone, or tablet. With almost everyone in the world with at least one of these devices many have access to applying for these jobs so the search could be overwhelming. Companies have come up with using questionnaires to determine who is best fit for the company and move them to the next step. The goal of the questionnaires is to find out if you are a good fit for both the job and the company, as well as to ask questions that might not be asked during the interview. Personality tests are also becoming more popular. According to Allison Doyle, Personality tests are used to determine your type of personality, your values, interests and your skills. They can be used to simply assess what type of person you are or, more specifically, to determine your aptitude for a certain type of occupation or career. Personality tests range from the five- minute Color Quiz which is supposed to determine your personality type by the colors you select, to the Myers-Briggs Type Indicator which is one of the top-rated personality tests that helps assess your personality type and helps to explore career options. HR uses such these methods because it makes their job a little easier. Social media is yet another means of reaching out to the world for talent companies post positions of sites such as facebook, twitter, and instagram. Sites like these are well known to many and used by companies all over to promote sales. Technology overall can allow companies to progress fast as long as the right people help set the tone. Change Change isnà ¢Ã¢â ¬Ã¢â ¢t always easy to introduce so first HR should use the eight step process outlined by Dr. Kotter. Organizations can avoid seeing their company fail or avoid the difficulty of change, by improving their ability to change; they can increase their chances of success in the future. These st eps include create sense of urgency, form coalition, develop change, communicate, remove obstacle, generate short term wins, build on change, and incorporate change into culture. Kotterà ¢Ã¢â ¬Ã¢â ¢s Process is known to be successful for over 70% of change in organizations. Thorough research is always needed so that all the information needs to be accurate and from a credible source. Once all the information is confirmed HR should begin reaching out to management informing them of the changes that will soon be taken place so that they can prepare to introduce it to the employees. If more organizations took these measures into making the companies better than they could see a huge change in how employees view their jobs. I feel if the company did their part in making employees feel more involved then workers will take more pride in to what they do and not just look at it as job the needs to be done. My company is huge and I understand that they canà ¢Ã¢â ¬Ã¢â ¢t praise each and every person but to be told good job or show some type of recognition would be greatly appreciated even if ità ¢Ã¢â ¬Ã¢â ¢s just from the managers. Only time we are acknowledged is when we are being reprimanded for something negative and things shouldnà ¢Ã¢â ¬Ã¢â ¢t be like that. Companies take the risk of failing because they donà ¢Ã¢â ¬Ã¢â ¢t take the time out to get the necessary information to implement change within the company. Kotters process is a known source and if more companies took the time out to take a risk finding new ways to operate then more success could be seen in the future. The Corporate Governance Policies Samples â⬠MyAssignmenthelp.com
Question: Discuss about the Corporate Governance Policies. Answer: Introduction The corporate governance policies implemented by a company ensure that the corporation is fulfilling interest of each stakeholder. The directors are responsible for ascertaining the importance of each stakeholder, and they have to formulate regulations that are focused on the satisfaction of their interest. Traditionally, the theorists provides that maximisation of shareholders interest in the primary goal of an enterprise. Shareholder theory asserts that the shareholder faces the primary risk in a firm by investing their capital, therefore, it is the moral duty of directors to maximise their return. The stakeholder theory ensures that the directors do not violate the moral rights of different stakeholders in a firm and equal balance should be maintained between the interest of shareholders and stakeholders. A company can benefit a large section of society by implementing a broader approach. This report will analyse various article on shareholder and stakeholder approach to determine their role in the development of company and community. The benefit of stakeholder approach over the society will be discussed in the report as well. Further, the report will evaluate theories of justice to analyse the moral duties of directors towards the stakeholders and provide a few suggestions for better implementation of stakeholder approach. Purpose The main purpose of this report is to review the articles on shareholder and stakeholder approach to analyse their impact on a company. Mainly the report will focus on theories given by R. Edward Freeman and Milton Friedman to understand the social responsibility of an organisation towards different stakeholders. Further, the report will examine the influence of adopting a stakeholder approach by an enterprise over the welfare of society. Many theories of justice will be discussed in the report to understand the moral and ethical duties of the company towards its stakeholders. The secondary purpose of this report is to analyse various theories of corporate social responsibilities and provide recommendations to directors for better implementation of stakeholder theory. Scope Mainly, the report will focus on studies of R. Edward Freeman and Milton Friedman regarding shareholder and stakeholder approach and its impact on corporations performance. Various other theories of corporate governance will be included in the report to understand the responsibility of directors towards stakeholders. The thematically approach is adopted in the report to review various studies of the theorist. Literature Review According to Ferrell Fraedrich (2015), a company is an artificial person created by the association of peoples to carrying on a commercial activity, the capital of the corporation is divided into small parts called shares, and people who invest their money into companies business is called shareholders. Previously, it was considered that a firm is liable towards its shareholders because they face the primary risk in an enterprise. Therefore, the directors should prioritise the interest of shareholders and formulate strategies to maximise the value of shareholders stock; this theory is called shareholders primacy. As per Shah Bhaskar (2007), due to the advancement of technology, regulations, and policies, modern companies did not prefer to implement a shareholder primacy model. For decades, maximising shareholders return was the primary focus of companies, this goal has been an inextricable factor of legislation in modern communities. In recent years, the growing popularity of stake holder approach has challenged the perception of shareholder primacy model. The companies adopt stakeholder approach rather them shareholder primacy model because it assists firm in fulfilling their social responsibilities. According to Smith (2003), the fundamental distinction provides that company should always focus on fulfilling the interest of stakeholder even if it reduces the corporations profitability. Friedman (2007) argued in his paper that the theory of stakeholder interest is against the growth of an enterprise, it is disadvantageous for the future progress of a firm. A company is an artificial person, therefore, it has artificial responsibilities, only human beings are socially responsible towards the society. Friedman (2007) stated in his article that the policy of stakeholder approach is started by trade unions and socialist groups to justify the activities of a company which is against its core values. A company is formed to satisfy the requirement of shareholders since they face the primary risk in a firm. Friedman (2007) provided that executives are the agent of shareholders and their primary responsibility is towards them. Boatright (2006) gives a similar theory in his article by providing that managers are not liable towards stakeholders, the directors failed to appreciate the benefit of shareholder primacy and how it benefits the interest of other stakeholders. Boatrig ht (2006) argued that it is not the responsibility of directors to formulate stakeholder-based policies in the firm, the shareholder primacy model automatically benefit the interest of multiple stakeholders. Freeman, Harrison, Wicks (2007) argued that the directors are not just answerable to shareholders, it is their duty to consider the interest of each individual or group to which affected by the operations of an organisation. The role of corporations is not just doing business anymore; the process of manufacturing has changed by the advancement of technology such as assembly line, which requires specialisation and hard work on employees to work correctly. According to Post (2003), while operating business in domestic or international markets, company has to follow new regulations provided by the government. The ownership of companies has become more dispersed because the corporations have the option to raise capital from different sources such as banks, financial institutes, and shareholders. Freeman, Harrison, Wicks (2007) stated that it is necessary that directors satisfy their employees, unions, government, investors, and shareholders to become successful, therefore, effective st akeholdermanagement policies are required in a company. The managing of stakeholders means creating as much value as possible for multiple stakeholders, without resorting to compromises. The directors manage the corporate governance of a company, therefore, it is their duty to formulate policies for the satisfaction of multiple stakeholders interest. Jensen (2002) argued that stakeholder theory should not be considered as valid because it does not focus on the satisfaction of fundamental corporate principles of a company. There is clarity in having a single objective model, such as shareholder primacy theory because stakeholder approach creates confusion, dispute, unproductivity and competitive failure of the company in the market. Another concept of Director Primacy Model is provided by the Bainbridge (2005), this model provides that directors are responsible for establishing corporate governance objectives, therefore, they should have the power to ensure relevancy of each stakeholder. The shareholders should not review the director's decision and the directors should focus on maximising shareholder stock value. This model has multiple flaws such as lack of review mechanism, no preference to creditors interest and no method to measure good faith of directors. According to Coelho, McClure Spry (2003), the modern corporations are not just profit machines; they have a social responsibility towards different sections of society and directors should formulate policies for the satisfaction of stakeholders interest. The growth of an enterprise is directly linked to the satisfaction of stakeholders interest; the directors should fulfill their ethical duties by satisfying the benefit of stakeholders. Benefit of Society by Stakeholder Approach The stakeholders in a corporation can be defined as individual or group who influenced or get affected by the achievement and failure of a firm. According to McVea Freeman (2005), a stakeholder invests money into firms operations and gets directly or indirectly affected by the actions of the enterprise. Stakeholders are divided into three categories: primary, secondary and excluded. The primary stakeholders have economic relationships with the firm, and they directly affected by the practices of a corporation. The primary stakeholder includes shareholders, employees, creditors, consumers and many others. The secondary stakeholders did not have any financial interest, but they get affected by actions of a firm. The example of secondary stakeholders is society, media, public and many others. The excluded stakeholders neither have a financial interest, nor they get affected by companys actions, but their opinion has significant influence over enterprises operations. The excluded stakeh olders include government, socialist groups, environment and many others. The primary and secondary stakeholders include a large part of society, and they assist company into attracting a large number of shareholders. It is necessary that directors satisfy the stakeholders interest to benefit various sections of society. As per the research of Martin (2010), a company cannot satisfy consumer and shareholder at once because it is impossible to meet two variables. The directors preferred shareholders approach but the satisfaction of stakeholders interest attracts a large number of a shareholder in a company. Zhang, Dawes Sarkis (2005) provided that the return of shareholders is determined after reduction of statutory payments such as taxes, wages and interest on debts; therefore, shareholders focus on future profits rather than present value. The directors can attract shareholders by enhancing future profits of a company which can only be achieved by fulfillment of stakeholders interest. The stakeholders approach equally distributes the capital between a so ciety which assists in the development of communities and corporation, and it is the responsibility of the firm to satisfy the interest of stakeholders. Theories of Justice Regarding Stakeholder Approach As per Ekvall, Tillman Molander (2005), the normative ethics examine the beliefs of a person; they are part of theoretical ethics. The normative ethics inspect the rightness or wrongness of an opinion, for example, if a person believes that stealing is incorrect than normative ethics analyse is it correct to hold such beliefs. Rawls (2009) describe justice as fairness of the acts; he further provided two concepts of justice. The first principle provides that equal freedom should be given to each individual and second provision retrain discrimination between parties unless it is the necessary to the benefit of minorities. The company should consider the interest of each stakeholder as equal, and directors should avoid discrimination to ensure proper implementation of justice theories. In shareholders primacy model, a company uses the peoples (other than shareholders) as a means to achieve the value maximisation of shareholders, the stakeholders of corporations are a means to an end t hat is increasing shareholders value. According to Jones, Felps Bigley (2007), Immanuel Kant provided that it is morally wrong of a company to use stakeholders merely as a means to an end, the peoples should always be treated as an end. As per Kantian view theory, each stakeholder has an equal position in a company and directors should not discriminate in their interest, in order to achieve the benefit of one section, the interest of other parts should not be violated. The Utilitarian theory is opposite of Kantian view model; it provides that it is not the duty of directors to consider the interest of stakeholders. The directors have agent principle duty towards shareholders, and they should perform every such action which is necessary for maximising their value, by following the law. The stakeholders interest will automatically fulfill by maximisation of shareholder value. Many theorists believe that this theory has no practical use in modern corporations since satisfaction of stakeholders assist in shareholders value maximisation. Rawls (2009) emphasis on equal wealth distribution between peoples because it assists in the overall development of the society. The directors have a duty of care and loyalty towards different stakeholders, the duty of care is analysing the interest of each stakeholder while formulating corporate governance policies. The duty of loyalty provides that directors should take appropriate actions to avoid the conflict of interest of various stakeholders. These duties force directors to fulfill the moral responsibilities of the company and ensuring that the firm adopts stakeholder approach. Other Stakeholder Theories Several theories apply stakeholder approach in a company and assist in the fulfillment of moral duties of a corporation. In recent times, corporate social responsibility approach is significantly popular among modern enterprises. According to Matten Moon (2004), the corporate social responsibilities implement various environmental and social measures into the framework of a firm which ensures that interest of different stakeholder being fulfilled by the company. The CSR policies focus on fulfilment of statutory principles along with the improvement of the society. There are numerous benefits of implementing CSR policy such as brand recognition, positive image, higher sales, ease in attracting investment and better retention of qualified employees. Another theory is Creating shared value model; it focuses on connecting competitive advantage with the CSR principles because it establishes health competition in the market. Porter Kramer (2011) stated that the director could apply Creating shared value theory by implementing a specific mechanism, such as reorganisation of objectives, redefining of products, and better serving in markets. The director can also apply a circular economy approach which can be beneficial for the corporation and society. According to Lieder Rashid (2016), the circular economy implements a regenerative system improve the impact of the company on community and environment. Various methods can be executed by the company, such as recycling, reusing, manufacturing better products, repairing and maintenance, which assists in the reduction of wastage, saving energy and better utilisation of resources. In case of modern corporations, the stakeholder approach is more beneficial since it helps in sustaining the future development of the firm. Conclusion and Recommendations In conclusion, adopting a stakeholder approach is beneficial for modern corporations because of its multiple benefits; it also assists companies in fulfilling their duties towards society. The enterprises have numerous responsibilities towards society, therefore, they cannot adopt a shareholder primacy approach since it is discriminating against other stakeholders. Various sections of society are benefited due to the implementation of stakeholder approach by a firm. As per the theories of justice, the directors have a duty of care and loyalty towards stakeholders, and they should ensure that equal benefits are provided to stakeholders. The directors can implement various approaches, such as circular economy, CSV, and CSR, to ensure that company fulfills the interest of its stakeholders. As per my recommendations, the company should change the focus from shareholders primacy approach by altering the terms such as maximising shareholders value to maximising companys values. The proper examination of companys operations should be performed by the directors to evaluate the number of stakeholders and their requirement. The directors should ensure that an adequate stakeholder approach is implemented by the company to fulfill its moral responsibilities towards the society. The director must analyse any external or internal factor which affects the interest of stakeholder, and proper regulation should be made regarding such elements. The directors should also continuously monitor the corporate social responsibility principles and update them as per the requirements. References Bainbridge, S. M. (2002).
